MOBILEHOME CONFERENCE - ORANGE COUNTY July 10, 2009 - Santa Ana - press release HEARING REPORTS "Mobilehome Park Wildfire Safety & Emergency Preparedness: Park 2 (Feb. 2009) [Pre-pdf version] "Mobilehome Park Wildfire Safety & Emergency Preparedness: Part 1" (Dec. 2008) "HCD Mobilehome Park Health and Safety Code Enforcement" (Feb. 2008) "Conversion of Mobilehome Parks to Subdivisions or Condominiums" (Feb. 2007) FREQUENTLY ASKED QUESTIONS on Mobilehome Issues Preguntas Frecuentemente Hechas (Spanish) LEGISLATION - Current 2009 Mobile/Manufactured Homes Legislation and Related Bills LEGISLATION - 10-Year History 1998 Mobilehome Final Bill List 1999 Mobilehome Final Bill List 2000 Mobilehome Final Bill List 2001 Mobilehome Final Bill List 2002 Mobilehome Final Bill List 2003 Mobilehome Final Bill List 2004 Mobilehome Final Bill List 2005 Mobilehome Final Bill List 2006 Mobilehome Final Bill List 2007 Mobilehome Final Bill List 2008 Mobilehome Final Bill List Statistics & Figures on Mobilehomes, Manufactured Homes and Mobilehome Parks in California Low Income Mobilehome Rehabilitation Programs in California Many local governments have rehabilitation or repair grants or loans for low income mobilehome owners in parks. Such rehabilitation may include roof repair, plumbing, electrical, etc. Other kinds of assistance including first-time homebuyer downpayment assistance, home acquisition or replacement, homebuyer counseling, self-help mortgage assistance programs, or technical assistance for self-help homeownership, and in some cases purchase of a homeowner interest in a resident-owned mobilehome park, may also be available depending upon the local program. This money is made available through the CalHome program, operated by the state Department of Housing and Community Development (HCD) but is administered by local governments and non-profit organizations as a part of voter approved state housing bond issues in 2002 and 2006. There are usually income and residency eligibility requirements, and some jurisdictions do not consider mobilehomes “real property” eligible for “rehab” funding or may have restrictions on the kinds of repairs that will be funded. Applications must be made at the local level, and not all local jurisdictions have such programs. The following is a contact list provided by HCD, as of October 2008, of jurisdictions that operate such programs. Those 73 jurisdictions which consider mobilehomes in parks eligible for rehabilitation assistance are indicated in blue. Those jurisdictions indicated in red do not provide CalHome funding for mobilehomes inside parks. This list and the policy of local jurisdictions regarding mobilehome funding eligibility are subject to change. The listing provides the name, address and telephone number of each park, access to location by map, the number of spaces per park, which agency has jurisdiction for park inspection, and the name of the park operator holding the permit to operate. This is a “Search” function and information can be obtained by the name of each park, or by city or county without the park name. If the name of the park is not correct, even by one letter, the search function will indicate “no listing.” In that case, when looking for a particular park search by city or county, if known, by scrolling down the city or county list until the park name is found. If you want to view the entire state list, do not fill in any blanks but simply click on “Search.” There is also a “Search” function for parks that have been closed or no longer hold a permit to operate. MOBILEHOME RESIDENCY LAW - Division 2, Part 2, Chap. 2.5 of the Civil Code The Mobilehome Residency Law (MRL) is basically the landlord-tenant law for mobilehome parks, the provisions of which, like conventional landlord-tenant law and other Civil Code provisions, are enforced in a court of law. The Department of Housing and Community Development (HCD) does not have authority to enforce violations of the MRL. To order multiple copies, call (916) 651-1538. LEY de RESIDENCIA de las CASA MOVILES (Spanish) Luật Cư Trú Nhà Lưu Động MOBILEHOME PARKS ACT - Division 13, Chap. 2.1 of the Health & Safety Code The "Mobilehome Parks Act (MPA)” establishes requirements for park permits, fees, and health and safety code responsibilities of park operators and code enforcement agencies, primarily the Department of Housing and Community Development (HCD). The Act also requires HCD to promulgate regulations to carry out this Act and enforce it – also see Title 25 below. The MPA does not relate to mobilehome park tenancies and should not be confused with the MRL (above). TITLE 25 REGULATIONS (Mobilehome Parks Act) - effective January 2, 2007 HCD regulations to carry out the Mobilehome Parks Act are contained in the California Code of Regulations, Title 25, Division I, Chapter 2 commencing with section 1000. The regulations include specific requirements for park construction, maintenance, use, occupancy, and design and include requirements for items such as lot identification, lighting and roadway width, plan and permit requirements, specific requirements for the installation of mobilehomes, accessory structures and buildings, earthquake resistant bracing systems, application procedures, fees, enforcement and appeal procedures. The Recreational Vehicle Park Occupancy Law (Chapter 2.6 of the California Civil Code) The Recreational Vehicle (RV) Park Occupancy Law is basically the landlord-tenant law for recreational vehicle (RV) and special occupancy parks, the provisions of which, like conventional landlord-tenant law and other Civil Code provisions, are enforced in a court of law. The Department of Housing and Community Development (HCD) does not have authority to enforce violations of the RV Occupancy Law. Landlord-Tenant Law Some provisions of conventional landlord-tenant law not in conflict with the Mobilehome Residency Law (see above) may also apply to mobilehome park tenancies.
